Terms and Conditions
1. Scope
These Terms and Conditions apply to the use of the “Ausbildung Germany” website and platform by companies, interested parties, applicants, candidates, and other users.
The provider of the platform is:
KGS Ausbildung Germany GmbH
Frankfurter Straße 63-69
65760 Eschborn
Germany
Any deviating terms of users shall apply only if we have expressly agreed to them in writing.
2. Services of Ausbildung Germany
Ausbildung Germany provides a digital platform for the presentation, search, review, and initiation of placements involving candidate profiles in the context of vocational training, recruiting, and international talent acquisition.
Our service scope may in particular include:
- provision of informational and marketing pages
- registration and administration of user accounts
- display of candidate profiles and company access
- search, filter, shortlist, and unlock functions
- communication and placement initiation functions
- supplementary support, review, or approval processes
There is no entitlement to specific functions or to unchanged availability at all times unless this has been expressly agreed contractually.
3. Conclusion of contract and user relationship
The mere use of publicly accessible content does not in itself establish a separate contract for paid services.
A user relationship regarding platform functions arises at the latest upon successful registration or upon use of a specifically offered service.
Where paid services, unlocks, or additional services are offered, a contract for such services is concluded only upon express confirmation, booking, or other binding completion of the respective process.
4. User accounts
Registered users are obliged:
- to provide truthful and complete information during registration,
- to treat access data confidentially,
- to report unauthorized access immediately,
- to keep their information up to date.
User accounts are not transferable without our consent.
We are entitled to reject registrations or temporarily suspend accounts if there are concrete indications of misuse, false information, security risks, or other material breaches of duty.
5. User obligations
Users undertake to use the platform only in accordance with applicable law and these Terms and Conditions.
In particular, it is prohibited to:
- post or distribute unlawful, misleading, or offensive content,
- infringe the rights of third parties,
- circumvent technical protection measures,
- access data, accounts, or systems without authorization,
- carry out automated bulk queries, scraping, or other abusive use,
- exploit content or profile data outside the agreed purpose of use.
Companies may use candidate information received only within the framework of legitimate recruiting and placement processes.
6. Content, profiles, and unlocks
We strive to provide profile information and platform data with due care. Nevertheless, we do not guarantee that all content is complete, current, or error-free at all times.
Where certain profile elements, contact details, documents, or assets become visible only after an unlock, the use of this content is permitted only within the intended platform logic and the agreed purpose of use.
Unlocked content may not be passed on to third parties without authorization, copied, or used for improper purposes.
7. Prices and payment terms
Where services are offered for a fee, the prices and conditions specified in the booking process, offer, contract, or on the platform shall apply.
Unless otherwise stated, all prices are exclusive of applicable VAT, where applicable.
Payments are due upon conclusion of the contract or in accordance with the specifically agreed payment terms.
In the event of late payment, we are entitled to assert statutory default rights and temporarily restrict affected services where legally permissible.
8. Availability and changes
We strive to ensure that the platform is available with as little interruption as possible. Maintenance, security updates, technical disruptions, or further development may nevertheless lead to temporary restrictions.
We are entitled to change functions, layouts, processes, and technical specifications insofar as this is reasonable taking into account the interests of users.
9. Term and termination
Unless otherwise agreed, the user relationship runs for an indefinite period and may be terminated ordinarily by either party.
The right to extraordinary termination for good cause remains unaffected.
Good cause exists for us in particular if a user materially or repeatedly violates these Terms and Conditions, statutory provisions, or third-party rights.
10. Rights to content and usage rights
All rights to the platform, its content, structure, databases, designs, texts, logos, and other elements remain with us or the respective rights holders.
Users are granted only a simple, non-exclusive, non-transferable, and revocable right to use the platform within the framework of these Terms and Conditions and the agreed purpose of use.
11. Liability
We are liable without limitation:
- in cases of intent and gross negligence,
- in the event of culpable injury to life, body, or health,
- under the provisions of the German Product Liability Act,
- where an express guarantee has been assumed.
In the event of slightly negligent breach of essential contractual obligations, our liability is limited to the typical foreseeable damage. Essential contractual obligations are obligations whose fulfillment is necessary for the proper execution of the contract and on whose compliance the user may regularly rely.
Otherwise, liability for slight negligence is excluded.
12. Data protection
Information on the processing of personal data can be found in our privacy notice.
13. Final provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions provide otherwise.
If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with the contractual relationship shall be our registered office, where legally permissible.
Should individual provisions of these Terms and Conditions be wholly or partly invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
